Activity Description:
Participation in a fishing charter operated by Triple B Guide Service LLC including but not limited to boat travel, fishing activities, and related recreational activities on Lake Okeechobee Fl, Kissimmee and the Caloosahatchee river.
Acknowledgment of Risks:
I, the undersigned, understand that participation in the fishing charter involves inherent risks, including but not limited to drowning, physical injury, property damage, equipment failure, slips and falls, seasickness, encounters with marine life, adverse weather conditions, and other unforeseen hazards. I acknowledge that these risks may result from my own actions, the actions of others, the condition of the vessel, or environmental factors beyond the control of Triple B Guide Service LLC.
Assumption of Risk:
I voluntarily assume all risks associated with participating in the fishing charter, whether known or unknown, and accept full responsibility for any injury, loss, or damage that may occur to me or my property.
Release and Waiver of Liability:
In consideration of being permitted to participate in the fishing charter provided by Triple B Guide Service LLC I hereby release, waive, discharge, and agree not to sue Triple B Guide Service LLC its owners, captains, crew, employees, agents, or affiliates from any and all liability for any claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the negligence of the Released Parties or otherwise, including but not limited to personal injury, property damage, or wrongful death, to the fullest extent permitted by law.
Indemnification:
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including attorney fees, that they may incur due to my participation in the fishing charter, whether caused by my negligence or otherwise.
Medical Acknowledgment:
I certify that I am physically and mentally capable of participating in the fishing charter and have no medical conditions that would prevent safe participation, such as severe motion sickness or heart conditions. I have disclosed any relevant medical conditions or limitations to Triple B Guide Service LLC In the event of an emergency, I authorize Triple B Guide Service LLC to secure medical treatment on my behalf, and I will be responsible for any associated costs.
Compliance with Rules and Safety Instructions:
I agree to follow all safety instructions, rules, and regulations provided by the captain and crew of Triple B Guide Service LLC, including wearing life jackets when required and adhering to all posted guidelines.
Governing Law:
This agreement shall be governed by and construed in accordance with the laws of Florida, and any applicable federal maritime laws. Any disputes arising under this agreement shall be resolved in the courts of Glades County Fl.
Severability:
If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
Acknowledgment of Understanding:
I have read this Release of Liability, Waiver of Claims, and Assumption of Risks, fully understand its terms, and sign it freely and voluntarily without any inducement. I am at least 18 years of age and have the legal capacity to enter into this agreement. If the participant is a minor, a parent or legal guardian must sign below.
